Haskell had a pre-existing neck condition that he aggravated at work when he heard a loud noise above him and turned his head suddenly. He filed petitions which Judge Greene denied on the grounds of legal causation. The Appellate Division reversed his decision, however, under Bryant and Celentano, finding that the risk of employment was "elevated" above the risk the employee faced in everyday life with his pre-existing condition.
